I wonder if anybody can tell me where i stand legally as a consumer.
I attended two sessions in two days and was badly burnt by the LED Phototherapy machine.
This was in a beauty salon. The owner destroyed my skin and then to make matters worse tried to sell me the most expensive moisteriser as a cure.
Two months on my face is totally destroyed.My face was completely white scales for one month, i have had to use steroid cream , but this has very bad side effects. now my face is totally burnt red and so tight and dry i can only feel my eyes. The face just feels dead. The salon put me on the machine twice in two days and were recomending i do 5 days. I now learn that for phototherapy machines, session every 4-6 weeks are recommended.
What should i do legally about this matter ?
This machine/business needs to be stopped before they wreck more people lives.

You have the right to clean bandages and to neve go back there again.
Reply:You have a couple courses of action. First, you could take the shop to civil court for the damages/suffering you endured. Next, you could contact the Better Business Bureau and report the business for faulty techniques/equipment and incompetent operators.

Reply:contact an attorney and sue. it sounds like the nerves in your face have been affected and that you may have scarring. you have a lot of options and also an obligation to hold this business accountable if they are in error.
also take plenty of pictures of the damage to your face and document your injuries, pain and symptoms.
i sat in on a court case of a woman who sprained her ankle in a car accident, she was awarded close to $200, 000.00. a lot of people sue for anything but its those (like yourself) who really deserve compensation that don't . don't make that mistake, you have been injured and scarred possibly for life, don't pay for their mistake.
Reply:You have two different actions here, one against the salon and one against the manufacturer of the machine. (If the operator wasn't trained properly or disregarded the instructions, the maker is off the hook.)
Get to a personal injury lawyer and let him take it from here, that's their specialty and he will rip them a new one.
To speed it up for him, bring him all your documentation including your medical records of your care up to date so he can review everything and get your case rolling. The salon should have liability insurance so you will get at a minimum your medical bills, future bills, and pain and suffering.
EDIT- Don't listen to this one answer on here, the fact they told you to come two days in a row and you did before the damage was evident will not mitigate their actions. You've got an excellent case to pursue.
Reply:definately contact an attorney and the better business bureau. but, did they make you sign something before the treatments? most places will make you sign a release, in case something goes wrong and they can't be held liable. but i would damn sure give it a try--that sounds way excessive. i hope you get better some!
Reply:This is a case of strict liability. The beautician whosoever he/she is, is supposed to be duly qualified licensed to practice and adept with the instruments which are employed for treatment. The beautician has to prove that she was not negligent in her professional work and cannot place responsibility on her tools. You having suffered on account of professional incompetence and negligence are entitled to file a suit for damages against the beautician. Do it soon before the evidence disappears.
